Smart Energy terms
1. Introduction and Overview
X2M Smart Energy (“X2MSE”) is offered by X2M Connect Limited (ABN 48 637 951 154) (“X2M”) in partnership with select providers (“Designated Partners”). X2M acts as the arranger of the bundled Smart Energy offering, not as the direct provider of individual products and services. Each component of the offering is delivered by the relevant Designated Partner under their own terms.
2. Scope of the Offer
The X2M Smart Energy offering is a bundled proposition comprising:
- Solar photovoltaic system installation
- Home Energy Management System (HEMS)
- Community battery participation
Two eligibility pathways are available:
Greenfields Offer, for new-build homes in designated estates, where the Smart Energy package is integrated during construction.
Retrospective Offer, for existing homes in designated estates, where the Smart Energy package is retrofitted to an established property.

3. Customer Eligibility
To participate in the X2M Smart Energy programme, you must be the owner or purchaser of a property within a designated estate and meet the eligibility criteria for your selected offer pathway (Greenfields or Retrospective). Additional eligibility requirements may apply and will be communicated during the enrolment process.
4. Roles and Responsibilities
X2M acts as the programme arranger and primary point of contact. Each Designated Partner is responsible for the delivery, installation, and ongoing support of their respective component of the offering. X2M does not provide individual products or services directly and is not liable for the performance of any Designated Partner’s obligations.
5. Pricing, Payment and Taxes
Pricing for the Smart Energy offering will be communicated during the enrolment process and may vary depending on the offer pathway, property configuration, and selected components. Payment arrangements, including any financing through NAB, are subject to the terms of the relevant Designated Partner. All prices are inclusive of GST unless stated otherwise.
6. Product Delivery, Installation and Integration
Delivery and installation timelines will be confirmed during the enrolment process. Installation of all components will be coordinated by X2M and carried out by the relevant Designated Partners. You agree to provide reasonable access to your property for installation and integration works.
7. Warranties and Support
Warranty terms for each component of the Smart Energy offering:

Warranty claims should be directed to the relevant Designated Partner. X2M will assist in coordinating warranty enquiries where appropriate but is not the warrantor.
8. Community Battery Participation
Participation in the community battery programme is subject to availability and the terms set by the third party battery owner/operator. An annual participation fee of $75 applies.
9. Data Privacy and Use
Personal information and energy data collected during your participation in the Smart Energy programme will be handled in accordance with X2M’s Privacy Policy. Your data may be shared with Designated Partners solely for the purpose of delivering and supporting your Smart Energy services. For full details, refer to our Privacy Policy.
10. Intellectual Property
All intellectual property in the X2M Smart Energy programme, including the X2M brand, platform technology, and programme materials, remains the property of X2M Connect Limited or its licensors. Nothing in these terms grants you any licence or right to use X2M’s intellectual property except as necessary to receive the Smart Energy services.
11. Termination or Withdrawal
You may withdraw from the Smart Energy programme by providing written notice to X2M. Termination may be subject to obligations already incurred, including any financing arrangements, installation commitments, or contractual obligations with Designated Partners. X2M reserves the right to terminate or suspend the programme or your participation at any time, subject to reasonable notice.
12. Liability and Disclaimers
To the maximum extent permitted by law, X2M’s liability in connection with the Smart Energy programme is limited to the re-supply of the relevant services or a refund of the fees paid for those services. X2M is not liable for any indirect, incidental, special, consequential, or punitive damages. Nothing in these terms excludes or limits any rights you may have under the Australian Consumer Law.
13. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of Victoria, Australia. You agree to submit to the exclusive jurisdiction of the courts of Victoria.
14. Acknowledgement
By enrolling in the X2M Smart Energy programme, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions. You acknowledge that X2M acts as the programme arranger and that individual products and services are delivered by the relevant Designated Partners under their own terms.
